These Terms and Conditions (hereinafter referred to as “Terms”) apply where an individual (hereinafter referred to as “You” and/or “Your”) purchases a travel Experience (hereafter referred to as “Experience”) from Pave Limited.
Pave Limited is registered with Companies House in the United Kingdom (company no.08545862). Pave’s registered address is 06, Westward House, Glebeland Road, Camberley, England, GU15 3DB.
For the avoidance of doubt, the singular meaning of words may be used in its plural form.
In these Terms, the words “We”, “Us”, Our and “Experience provider” refer to Pave.
These Terms are the basis of a legally binding contract between Pave and You. By booking a place on an Experience offered by Pave, You agree to be bound by these Terms.
You should read these Terms before making payment to confirm Your booking and retain a copy of these Terms for future reference.
Deposit Requirement For Booking
You are required to pay a deposit of £250 per person per Experience for Your booking to be made and confirmed.
If Your booking is made within (thirty) 30 days of the departure date then the full amount is payable at the time of booking.
Please note that some selected Experiences may require different deposit amounts. You will be notified of the exact deposit amount required for each Experience at the time of booking.
Booking Acceptance And Payment
Your booking is confirmed and a contract exists between You and Us when We or Our disclosed agent issues a written confirmation after receipt of the applicable deposit amount.
Where applicable, Your booking confirmation will include details of the final payment(s).
The final payment of the balance of the trip price is due no later than (fourteen) 14 days after the final invoice date.
Where making a booking within thirty (30) days before the start of the Experience, full payment should be made at the time of the booking.
If Your payment balance is not paid on or before the due date We reserve the right to treat Your booking as cancelled and the cancellation charges outlined at Clause 5 will apply.
In case you require more time to pay your balance, please advise us as soon as possible. We will assess each situation individually before responding back with a response as to the feasibility of a payment deadline extension.
Booking On Behalf Of Others
By booking on behalf of other participants, You are deemed to be the designated contact person for every participant included on that booking.
This means that You are responsible for making all payments due in connection with Your Experience booking, notifying Us or Your travel agent if any changes or cancellations are required and keeping Your party informed.
By booking on behalf of another person or persons, You represent and warrant that You have obtained all required consents. You are responsible for verifying that any information You provide on behalf of another participant is complete and accurate, and Pave will under no circumstances be liable for any errors or omissions in the information provided to complete a booking.
Cancellations & Charges
If You are a consumer and are not entering into the Contract for purposes connected with a business, then You have a legal right under the Consumer Contract (Information, Cancellation and Additional Charges) Regulations 2013 to cancel the Contract within (fourteen) 14 days (the “Cancellation Period”) without giving any reason.
The Cancellation Period will expire (fourteen) 14 days after the date of payment of the deposit or first payment towards the Experience.
To cancel within the Cancellation Period You must send Your cancellation request in writing to our registered address or by e-mail to [email protected].
Pave may Cancel the Experience on the specified dates:
if it unexpectedly is unable to provide the Experience for the dates specified,
An Event Out of Our Control (refer to Clause 26 for details) prevents Us from providing the Experience, or
with 14 days prior written notice where it determines that the number of delegates is insufficient to justify running the Experience. In such circumstances, a full refund of any Experience fee will be provided in settlement of any claim.
Refund Policy
If You cancel in accordance with paragraph 5.1, We will refund the fees You have paid within (fourteen) 14 days of the date on which You inform Us that You wish to cancel.
If You give Us written notice to cancel the Contract outside the Cancellation Period but at least (sixty) 60 days before the Experience starts, You will be entitled to a (fifty percent) 50% refund of the Course fees You have paid minus the deposit.
If You give Us written notice to cancel the Contract outside the Cancellation Period and fewer than 60 days before the Experience starts, You will not be entitled to any refund of the Experience fees.
If You wish to cancel or withdraw from the Experience after the Experience has started, You shall not be entitled to any refund of fees paid and/or will still be liable for any outstanding fees to be paid. Please ensure that Your sponsor, where applicable, is aware of this.
Refunds will be paid in Great British Pounds sterling (GBP) and We will not be responsible for any losses You suffer as a result of any currency exchange fluctuations or exchange fees.
We will endeavor to pay refunds by the same means as You paid the Experience fees.
Transfer & Changes Of Booking
If You wish to transfer from one Experience to another You must notify us at least (sixty) 60 days prior to the proposed Experience start date. A fee of £250.00 (GBP) per person per change will apply (in addition to any charges levied by hotels, ground operators or airlines).
If you notify Us less than 60 days prior to the proposed Experience Start Date the refund policy applicable to cancellations will apply. Transfers to another Experience can only be made to an Experience within the current validity period.
If You or another Participant in Your booking is prevented from travelling, that person(s) may transfer their place to someone else, subject to the following conditions:
That person is introduced by You and satisfies all the conditions applicable to the Experience;
We are notified not less than fourteen (14) days prior to departure;
You pay any outstanding balance payment, an amendment fee of £250.00 (GBP) per person transferring, as well as any additional fees, charges or other costs arising from the transfer; and
The transferee agrees to these booking conditions and all other terms of the contract between Us.
You and the transferee remain jointly and severally liable for payment of all sums. If You are unable to find a replacement, the refund policy as set out in clause six (6) will apply in order to cover our estimated costs. Otherwise, no refunds will be given for passengers not travelling or for unused services.
Any amendments You wish to make to Experience options in Your current booking and any other arrangements made in conjunction with Your Experience, will incur a £75.00 (GBP) administration fee per booking per change. This fee is in addition to any charges levied by hotels, ground operators or airlines. No amendments are permitted to Your booking within (ten) 10 days of departure.
Fees and Surcharges
Our Experience fees are subject to variable and seasonal pricing. This standard practice within the travel industry refers to Our Experience fees varying from time to time in accordance with demand, market conditions and availability. This means Participants may have been charged a different fee on the same Experience. Your best option if You like the price You see is to secure it at that time.
Any reduced pricing or discounts that may become available after You have paid Your deposit will not apply.
If you wish to cancel Your booking to book at a cheaper price, full cancellation charges and refund policies outlined in clauses five (5) and (six) 6 will apply. The most up-to-date pricing is available on Our website. We reserve the right to impose surcharges up to (sixty) 60 days prior to departure due to unfavorable changes in exchange rates, increases in airfares or other transportation costs, increases in local operator costs, taxes, or if government action should require us to do so.
In such instances We will be responsible for any amount up to (two) 2% of the Experience fee price and You will be responsible for the balance. If any surcharge results in an increase of more than (ten) 10% of the Experience fee You may cancel the booking within (fourteen) 14 days of notification of the surcharge and obtain a full refund.
Your Details
In order for Us to organise and confirm Your travel arrangements You must provide all requested details with the balance of the Experience fee. Necessary details vary by Experience. They include, but are not limited to:
Full name as per passport;
Date of birth;
Nationality;
Passport number;
Passport issue and expiry date; and
Any pre-existing medical conditions You have which may affect Your ability to complete your travel arrangements.
On some more demanding Experiences, We also require You to complete and forward a Self-Assessment form. Failure to provide requested details may result in additional charges or non-refundable cancellation of Your Experience.
Experience Inclusions
The price of your Experience includes:
All accommodation as listed in the Experience profile
All events and experiences forming part of the official Experience itinerary
All on ground transport as listed in the Experience profile
Meals as listed in the Experience profile
The services of staff in booking and administration of logistics as described in the Experience profile
The on-ground services of Staff in overseeing and leading the Experience as described in the Experience profile
Experience Inclusions
The price of Your Experience does not include:
International or internal flights unless specified
Kitty as specified in the Experience Information
Airport transfers, taxes and excess baggage charges unless specified
Meals other than those specified in the Experience profile
Visa and passport fees
Travel insurance
Optional activities and all personal expenses
Kitty
On some Experiences you are required to contribute to a Kitty. The Kitty is a compulsory on-ground payment put into a central fund and overseen by the Participants and Staff. It funds only meals and some included activities. Kitty amounts are based on the Experience on a case-by-case basis.
Age And Health Requirements
Minimum Age: For the majority of our Experiences the minimum age is sixteen (16) at the time of travel. All Participants under the age of (eighteen) 18 must be accompanied by a legal guardian, or in lieu of a legal guardian, by an escort over the age of (eighteen) 18, appointed by their legal guardian. The legal guardian or their designee will be responsible for the Participant under the age of (eighteen’s) 18’s day to day care. If a legal guardian elects to designate an escort in their lieu, they will be required to complete and sign a relevant document, to delegate their authority.
Please note We cannot guarantee triple or adjoining rooms for families; accompanying adults may be required to share with others in the group on a twin share basis.
Variations: A minimum age of (eighteen) 18 applies to many Experiences which are physically demanding, while a lower minimum age applies to many cultural Experiences. Please check with Your booking agent at the time of enquiry.
Maximum Age: For the majority of our Experiences We have no upper age limit though We remind You that some of Our Experiences can be physically demanding and Participants must ensure that they are suitably fit to allow full participation.
We are able to provide details on mandatory health requirements; however, We are not medical experts. It is Your responsibility to ensure that You obtain proper and detailed medical advice at least (two) 2 months prior to travel for the latest health requirements and recommendations for Your destination.
Flexibility on Local Activities And Transportation
You appreciate and acknowledge that the nature of this type of travel requires considerable flexibility and you should allow for alternatives. The itinerary provided for each trip is representative of the types of activities contemplated, but it is understood that the route, schedules, itineraries, amenities and mode of transport may be subject to alteration without prior notice due to local circumstances or events.
Passport And Visa
Passport: You must carry a valid passport with two blank pages and ensure it has a minimum six (6) months validity from the Experience start date.
Us processing Your visa: In most instances, We will prepare Your visa application to Your destination’s High Commission for You.
Our services however do not include the consulate fee payable to the High Commission and You are therefore required to pay for the visa consulate/embassy fee separate to the Experience fee.
When We process Your visa, You must provide Us with Your passport and all supporting documentation within (forty-eight) 48 hours, from the date requested.
In the event You fail to comply or provide Us with this fee, You will lose your right to a refund as per clause (five) 5 plus a £250.00 (GBP) administrative charge will be applicable.
If Your visa application is unsuccessful, You will be entitled to a refund as per clause (five) 5 minus a £100.00 (GBP) administration charge and the visa consulate/embassy fees.
If You request a re-application of any initial unsuccessful visa application, it is at Our discretion. If We agree to another attempt at Your visa application, You will pay a £150.00 (GBP) administration charge and any additional costs including but not limited to, visa consulate/embassy fees, express processing, postage and submission in person fees.
You processing Your visa: If You make a booking within sixty (60) days of the Experience Start Date, You must process Your visa application.
If You make a booking for an Experience and live outside of the UK, You must process Your visa application.
Where You are required to complete the visa processing Yourself, We will support You with as much expert advice and knowledge as possible with Your visa application. However, please note it is Your responsibility to ensure that you are in possession of the correct visas, permits and certificates for your Experience in India.
If for any reason You are issued the wrong length or type of Indian visa for an Experience, We reserve the right to refuse participation on the Experience. If You pursue an Experience with any incorrect visa, permit or certificate without informing Us, We are not liable for any consequences of this decision.
Travel Insurance
Travel insurance is mandatory for all Our Participants and should be taken out at the time of booking. Your travel insurance must provide cover against personal accident, death, medical expenses and emergency repatriation with a recommended minimum coverage of GBP £250,000.00 for each of the categories of cover. We also strongly recommend it covers cancellation, curtailment, personal liability and loss of luggage and personal effects. You must provide Us with a copy of Your travel insurance policy and the insurance company’s 24-hour emergency contact number (thirty) 30 days before Your departure; You will not be able to join the trip without these details. If You have travel insurance connected to Your credit card or bank account please ensure You have details of the participating insurer, the insurance policy number and emergency contact number with You rather than the bank’s name and credit card details.
Flexibility
You appreciate and acknowledge that the nature of this type of travel requires considerable flexibility and You should allow for alternatives. The itinerary provided for each Experience is representative of the types of activities contemplated, but it is understood that the route, schedules, itineraries, amenities and mode of transport may be subject to alteration without prior notice due to local circumstances or events.
Change Of Itinerary
While We make every effort to operate all Experiences as described We reserve the right to change the Experience itinerary. You can refer to Us before departure for the most recent updates to Your itinerary.
If We make a major change before departure We will inform You as soon as reasonably possible if there is time before departure. The definition of a major change is deemed to be a change affecting at least one in five days of the itinerary. When a major change is made You may choose between accepting the change, obtaining a refund of money paid on that portion of the Experience only or accepting an alternative activity offered.
We reserve the right to change an itinerary after departure due to local circumstances or events outside of Our control. In such emergency circumstances the additional cost of any necessary itinerary alterations will be covered by You. Please note We are not responsible for any incidental expenses that may be incurred as a result of the change of itinerary such as visas, vaccinations or non-refundable flights.
Authority On Experiences
Our group Experiences are run by a group leader. The decision of the group leader is final on all matters likely to affect the safety or well-being of any Participant or staff member participating in the Experience. If you fail to comply with a decision made by a group leader or interfere with the well-being or mobility of the group, the group leader may direct You to leave the Experience immediately, with no right of refund. We may also elect not to carry You on any future Experiences booked. You must at all times comply with the laws, customs, foreign exchange and drug regulations of the country, and You also agree to travel in accordance with Our and local responsible travel guidelines.
Acceptance Of Risk
You acknowledge that the nature of the Experience can be adventurous and participation involves a degree of personal risk. You will be visiting places where the political, cultural and geographical attributes present dangers and physical challenges greater than those present in Our daily lives. We use information from government foreign departments and reports from Our own networks in assessing whether the itinerary should operate. However, it is also Your responsibility to acquaint Yourself with all relevant travel information and the nature of Your itinerary. You acknowledge that Your decision to travel is made in light of consideration of this information and You accept that You are aware of the personal risks attendant upon such travel.
Limitation Of Liability
We contract with a network of organisations, governmental agencies and in-country individuals to assist in the running of our Experiences as agent for these third parties. We are not responsible for the acts and omissions of these third parties.
To the fullest extent permitted by law:
any liability for any loss, death, injury or damage which You may suffer (directly or indirectly) in connection with or arising out of Your participation in an Experience, or any breach of the Booking Conditions, is excluded;
You release Us and Our officers, employees, agents and representatives from any liability and expressly waive any claims You may have against Us arising out of or in connection with Your participation in an Experience; and
any condition or warranty which would otherwise be implied by law into these Booking Conditions (Implied Warranty), is excluded.
To the extent an Implied Warranty cannot be excluded, our liability in respect of the Implied Warranty is limited to (in our absolute discretion):
the provision of a similar trip to an equivalent value; or
a refund of the total amount received by Us from You in connection with Your booking.
Any claim by You is excluded to the extent that it is for indirect or consequential loss, loss of profits or economic loss, however it arises, or for indirect, special, punitive or exemplary damages.
Optional Activities
Optional activities not included in the Experience fee do not form part of the Experience or this contract. You accept that any assistance given by Your group leader or local representative in arranging optional activities does not render Us liable for them in any way.
The contract for the provision of an optional activity is between You and activity provider.
Complaints
If You have a complaint about your Experience please inform Us at the time of the Experience to Our in-country Pave contact so We can attempt to rectify the matter. If satisfaction is not reached through these means then any further complaint should be put in writing to us within (thirty) 30 days of the end of the Experience.
Severability
In the event that any term or condition contained in these Booking Conditions is unenforceable or void by operation of law or as being against public policy or for any other reason then such term or condition shall be deemed to be severed from this contract or amended accordingly only to such extent necessary to allow all remaining terms and conditions to survive and continue as binding.
Photos & Marketing
You consent to Us using Our staff members, professional photographers and videographers join and capture images and video footage on a group Experience which You are a Participant of.
You permit Us using images of You taken during the Experience for advertising and promotional purposes in any medium We choose. You grant Us a perpetual, royalty-free, worldwide, irrevocable licence to use such images for publicity and promotional purposes.
Events Outside Our Control
“Event Outside Our Control” means an event or circumstances beyond Our reasonable control, including visa rejections, extreme adverse weather conditions, power failure, loss of internet or poor connectivity, urgent or necessary maintenance that may arise from time to time, technical problems, strikes, and acts of God.
We shall not be responsible for any failure to perform or delay in performing Our obligations under the Contract that is due to an Event Outside Our Control.
If an Event Outside Our Control takes place which affects Our obligations under the Contract then:
We will contact You as soon as reasonably possible to notify You;
Our obligations under the Contract will be suspended and Our time for performance extended for the duration of the Event Outside Our Control; and
We will restart the Services as soon as possible when the Event Outside Our Control is over.
Privacy Policy
Please refer to full details of Our Privacy Policy however, any personal information that We collect about You may be used for any purpose associated with the operation of an Experience or to send You marketing material in relation to our events and special offers.
The information may be disclosed to Our agents, service providers or other suppliers to enable Us to operate the Experience. We will otherwise treat Your details in accordance with Our privacy policy and the General Data Protection Regulation.
Other Important Terms
We may transfer Our rights and obligations under these Terms to another organisation, and We will always notify You in writing if this happens, but this will not affect Your rights or Our obligations under these Terms.
This contract is between You and Us. No other person shall have any rights to enforce any of its terms.
Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
These Terms are governed by English law. You and We both agree to submit to the non-exclusive jurisdiction of the English courts.
